In a landmark ruling, the Supreme Court of Nigeria has reaffirmed the constitutional authority of state governments to regulate lotteries and gaming activities within their jurisdictions. This decision nullifies the National Lottery Act, marking a significant victory for Lagos State and a step towards true federalism.
The case, identified as Suit No. SC/1/2008, was brought before the Supreme Court by Lagos State, challenging the National Lottery Act, which had centralised the regulation of lotteries and gaming under federal control. The Supreme Court’s decision underscores the principle that the regulation of lotteries and gaming is a residual matter, falling squarely within the purview of state governments.
Gbenga Omotoso, Lagos State Commissioner for Information and Strategy, described the verdict as a historic triumph for the rule of law and constitutional democracy. “The Supreme Court’s decision affirms that the regulation of lotteries and gaming is a residual matter, squarely within the purview of state governments,” Omotoso stated.
This ruling is seen as a testament to President Bola Ahmed Tinubu’s enduring vision for true federalism. Omotoso highlighted the judgment as “a fitting tribute to his progressive leadership and relentless pursuit of restructuring”. The decision empowers states to chart their own regulatory frameworks, reinforcing the principles of federalism and state autonomy.
Former Lagos State Governor, Babatunde Raji Fashola, SAN, was also praised for his commitment to resolving contentious constitutional issues in court, paving the way for this outcome. Omotoso commended Governor Babajide Sanwo-Olu’s unwavering dedication to upholding the rule of law and defending the rights of Lagosians, which he described as pivotal to the legal victory.
The Lagos State Lotteries and Gaming Authority (LSLGA) remains the sole regulatory body for gaming activities in the state. Omotoso urged illegal and unlicensed operators to regularize their operations with the authority or face prosecution. “The Lagos State Government will continue to foster a conducive environment for legitimate businesses while protecting residents from the adverse effects of unregulated gaming,” he said.
This ruling is expected to significantly contribute to the state’s economic growth and the prosperity of its citizens. The gaming sector, under proper regulation, is poised to become a major economic driver for Lagos State.
