Dr. Femi Olaleye’s bail requirement was reduced by a court in Ikeja, Nigeria, on Wednesday from ₦50 million to ₦40 million. Dr. Olaleye is the medical director of the Optimal Cancer Care Foundation.
Justice Ramon Oshodi lowered the bail after the defendant’s lead attorney, Mr. Babatunde Ogala, SAN, moved an application and requested that the court lower the defendant’s bail to ₦10 million and that one of the sureties be a member of the defendant’s family or a professional acquaintance.
The State Counsel, led by Mr. Babajide Martins, Director of the Department of Public Prosecution (DPP), did not oppose to the motion and left it up to the court’s discretion.
Ramon, however, lowered the bail from ₦50,000,000 to ₦40,000,000 with two sureties in the same amount in his judgement.
According to his decision, the sureties must be owners of real estate in Lagos State, and each property’s worth must be equivalent to the ₦40 million bail amount.
“I have carefully considered the affidavits evidence and written submission filed on behalf of the defendant.
“However, I do not agree that the bail term be varied on the terms dictated by defence. I consider the appropriate issue for determination as this court exercise its discretion in favour of the defendant by varying the bail condition in the ruling of Nov. 30.
“The defendant is hereby admitted to bail in the sum of ₦40 million with two sureties in like sum. The sureties must be owners of build up properties in Lagos State and each property property must be sufficient to cover the bail sum.
“Original titled of the documents must be property must be submitted to the chief registrar of the court.
“Both sureties provide proper identification including the national identification and must show evidence of tax payment to the Lagos State Government in the last three years.,” the judge held.
Ramon also directed the defendant to present his British passport, Nigerian international passport, and any other legitimate documents to the chief court registrar.
In a 17-paragraph document dated December 20, the defence attorney requested that the court reassess the defendant’s bail condition and give Jim bail with lenient restrictions.
The defendant’s wife, Mrs. Aderemi Fagbemi-Olaleye, testified in court on December 19 that her husband had a sex addiction diagnosis.
Olaleye is accused of violating Sections 137 and 261 of the Lagos State Criminal Laws of 2015 on two charges of defiling and sexual assault by penetration.
The trial was continued and the matter was postponed until January 3.
